The County cannot issues building permits within wetlands, and all structures must also be at least 25 ft. from the edge of the mapped wetlands.
A "wetlands delineation" would be needed to define the area of wetlands to create an area to build but it is expected that a delineation will confirm the diagram of the wetlands. Kent County would go by that delineation as opposed to the DNREC wetland maps.
The trees in the wetlands can be harvested for timber, but the stumps cannot be cleared or removed to convert it to crop land to grow vegetables without DNREC and/or approval from the Federal Govt.
